Question on a Syclone sale, kind of complicated.

I have an out of state buyer for my Syclone. He is getting a loan from a credit union. The loan is secured by the title. They will not wire the money because they need the title first. They will send a cashiers check, then I have 10 days to get them the title, or the check is canceled. That's seems OK, but I asked if the buyer can reverse the check. They said he can if he gets a lawyer and says he did not get what he paid for. How would you proceed?

Travel to him and deliver the title in hand once funds have been verified . 10 days can go by quick if a problem arises and then your check is bunk .Face to face is the way to do business when regarding large amounts of money ..

tell him to bring cash, if its his loan he should be able to get the funds anyway he wants, when you get cash in hand, say bye bye to your sy.

cash is king. If there's a problem and you can get burnt, I wouldn't take a check or anything other than cash.

Thats his problem, not yours. When I sold my Ty, I met the guy at the bank with the title. They came to my house and wanted the title the day before, and I refused to hand it over with out a certified bank check. Have him drive or fly up with the check and get the title or have him go with you to one of the bank's branches by your house and do the deal.

I don't sign off on the title unless I have cash or a certified bank check, then they get the title.

When you do the "Bill of Sale", even lawyers understand the words "used - as is, where is" and "all sales are final". By the way, once a bank issues a cashiers check, it can not be refunded or canceled unless it was paid for with counterfiet cash dollars. Federal Banking Commission Law..... but cash removes all doubt!

I would go to a local branch of the bank if there is one, or just have a bill of sale spell out every detail of the sale and have it notorized and you should be ok, then if he tries to come back and say he never got the truck but you got the money you got a notorized bill of sale that will hold up in court and he will have nothing.

give them the title. have them give you the check. take check to your bank. ask how long for funds to clear. wait that amount of time,call bank to make sure all is well. (if the buyer really wants the truck they'll wait a week) THEN release the truck. if the funds bounce the worse is you apply for duplicate title. i would make a copy of title before you send away the original just in case. The key here is to not releasing the truck until the funds clear. has worked painlessly for me many times. GT

I was the guy trying to buy the truck. The check was a restricted endorsement from my credit union but seller wanted instant money transfer before he'd ship the truck. See my problem with that? I offered to overnight the check and let him take it to the bank and let it clear. No go. Then I became suspicious of the vehicle condition if he was worried about me trying to get my money back after I got the truck, so I volenteered to fly from Oklahoma to PA to look at the truck and pick it up with check in hand and drive it the 1000 miles home. He was unwilling to drive an hour to bring the truck to the airport for me to look at and suggested I rent a car. I said I wouldnt and I didnt get a reply until 3 or 4 days later offering to pay for a cab ride, but I have already found another truck local and I'm going to get it next week. I would have loved to have Turbo O's truck but he apparently he wasnt as interested in selling as I was in buying so I took my money elsewhere. I hope he sells it, he was very nice but just didnt work hard enough to sell it.

Well I kinda doubt that if you were a scammer you would bother to post here so I will say several that may help you ou for the future.

1. Welcome! Were glad you found a truck and hope you that you you join in often!

2. The scammers get treated pretty bad by us and we are all pretty leary of people not know or at least that we can't get a reference on, soooo ....cash on the barrel head is the best for larger transactions and in person, paypal, bid pay, C.O.D. etc. for parts a lot of the time. Some of the boys will send M.O.'s after you have been around for a while, some won't.

3. If you you don't feel that the seller of the truck, parts or what ever is "in the selling mood" or if you just have this funny feeling that somthing doesn't seem right, check it out thoroughly and don't be afraid to ask questions! There are enough nice trucks out there that you can just walk away if you don't feel that the fella want's you business very bad or if it's a scam. You can't drive a check so it's not sold till you have money in hand.

Thanks for the welcome. I'm a pretty respected member and moderator on a good size ATV forum, if you'd like reference I'd be more than happy to link you. I plan on being on often, there is so much knowledge on here I'd be stupid not to. So again, thanks for the welcome, and the pointers as well.

New to the SyTy thing, but I've been around the offroad and small engine performance scene for a few years. The other truck will be home this wednesday if all goes to plan, all thats left is for me to go pick it up. There will be pictures to follow shortly after, but I do have a crappy cell phone picture from the autotrader listing.
