I am sure most of you know the story about the "Red Framed Sy" I sold Dennis in the end of 2009. Basically in August of 2009 I paid a local towing company $250 to get me a title for a Sy I purchased for $4000 in a billion pieces. They told me at the time that it should take between 60-90 days. That was nearly a year ago and I sold the Sy in the meantime to Dennis in lieu of a title. This has been going on for to long now, and it has been a giant pain in my ass as well as Dennis'. So this morning I wake up and I have a PM from a board member letting me know he can get the title for Dennis for the $250 I offered. The reason that I offered that amount is because that is what the towing company charged me to get the title originally. They also said that if they can't get the title that I would get my money back. So today I called them and let them know basically that I had another option to get Dennis his title and I need to come pick up that $250 so I can go that route and make everyone happy. She says to me "I can't give you your money back because we used that plus more for filing fees." So know after I pay the other board member $250 to get the title for Dennis I am out well over $500. What should I do? I think I should file a small claims suit to get my money back but I am not sure.
I know if I get paid to detail a vehicle and I don't do it I can't just say to the customer "screw you I am not giving you your money back because I spent it on chemicals."
If anyone has any ideas for me please let me know.
