I would keep it unless it was a huge deposit like 4 grand, then I would keep $500 or so and give the rest back.

Unless you you wrote up it as non refundable deposit, legally you are supposed to give it back. I know someone who was brought to small claims court over a deposit and the seller had to return the deposit plus pay interest and court fees.

Relist the truck for sale, keep deposit until new buyer gets truck, return deposit.

We got an agreement worked out. I am giving half of the deposit back. I think its fair given the situation and he agreed.
